Keyes also ran against Obama as a Republican for the U.S. Senate seat in Illinois in 2004. Obama won that election to serve his first and only term in the U.S. Senate.

 

Dont be suprised that Keyes brings forth some new discoveries, he is a man who dosn't speak unless he has confirmed what he knows.

New Lawsuit Filed To Stop California Electoral College

Former presidential candidate Alan Keyes joined the fight to release President-elect Barack Obama's birth certificate this week, suing to keep the California Electoral College from meeting.

 

The suit is the latest of many lawsuits filed requesting the birth certificate, a document that Mr. Obama has so far refused to produce in court. The lawsuit, filed by Mr. Keyes and the American Independent Party (AIP) in the California Superior Court in Sacramento, requests the court to bar the secretary of State from certifying the names of electors to Gov. Arnold Schwarzenegger, R-Calif., and from transmitting a certificate of election each presidential elector.

 

"I and others are concerned that this issue be properly investigated and decided before Sen. Obama takes office," said Mr. Keyes in an AIP press release. "Otherwise there will be a serious doubt as to the legitimacy of his tenure. This doubt would also affect the respect people have for the constitution as the supreme law of the land. I hope the issue can be quickly clarified so that the new president can take office under no shadow of doubt. This will be good for him and for the nation."

 

The Electoral College will meet in each state capital to cast its votes on Dec. 15. Dec. 1 is also an important debate in the controversy, as Mr. Obama must respond to a federal case in the U.S. Supreme Court by that date, which will be heard by Justice David Souter, a jurist with a liberal reputation.

 

Mr. Keyes, an ambassador during the Reagan administration, was a presidential candidate in 2008 for the AIP. Mr. Keyes also ran against Mr. Obama for a U.S. Senate seat in 2004, losing to Mr. Obama by a wide margin.

 

The controversy over Mr. Obama's birth certificate has been boiling on the news periphery for months. Over the summer, Mr. Obama put an electronic scan of a birth certification on his "Fight the Smears" Web site in an effort to quiet rumors. The document has been unconvincing for his critics, due to flaws in the scan and its low quality. The raised seal and authoritative signature needed to validate the document cannot be seen on the scan at all.

 

According to the U.S. Constitution, there are distinct requirements to become president.

 

"No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of president," it reads.

 

In Pennsylvania, attorney Philip J. Berg filed a suit against Mr. Obama and the Democratic National Committee in August, in the hopes that Mr. Obama would produce his original birth certificate. Mr. Berg asserts that Mr. Obama was born in Kenya.

 

The case was thrown out of the Third Circuit Court in November because the judge ruled Mr. Berg had no standing to enforce the presidential requirements of the Constitution. Mr. Berg has since requested the U.S. Supreme Court hear the case, and Mr. Obama has until Dec. 1 to file his request that the court not hear the case. Once he has responded, the Court will rule on whether or not the case will be heard.

 

The Hawaii Department of Health says the original birth certificate is in its vaults, but refuses to release it on the grounds of Hawaii's privacy statutes. According to the statutes, only somebody with "direct and tangible interest" may access the birth records. This usually means that only Mr. Obama, his family, or somebody designated by him could access the document.

 

Longtime Obama critic Andy Martin is pursuing his own lawsuit to produce the birth certificate against the Hawaii Department of Health, arguing for the certificate's release. Hearings were heard in court on Tuesday, and Mr. Martin said the arguments were spirited.

 

"We had about a half-hour hearing," said Mr. Martin on his blog (http://contrariancommentary.blogspot.com). "Both the attorney general and I vigorously presented our respective positions. ... I have ordered a transcript of the hearing and as soon as it arrives we will post it on our blogs ... Rather than characterize what was said, I will allow everyone to review the presentation for themselves."

 

The judge reserved his judgment on Mr. Martin's case until a later date.

US Supreme Court to Review Challenge of Barack Obama’s Citizenship

 

On December 5, 2008 the United States Supreme Court is expected to meet to review a case being brought by Leo C. Donofrio against Nina Wells, the secretary of state in New Jersey, which challenges whether or not Barack Obama is a "natural-born citizen" and thus qualified under the U.S. Constitution's to become president. Ironically Donofrio’s suit also claims that Sen. John McCain’s name should not have been on the election ballot for the same reason.

 

The case, which was unsuccessful at the state level, is not expected to find much success with the Supreme Court. However if four of the nine justices vote to hear the case in full, oral argument may be scheduled.

 

Questions linger regarding Barack Obama’ s citizenship despite the fact that his campaign has posted the President-Elect’s live certificate of birth at FightTheSmears.com.

 

Another action questioning Barack Obama’s citizenship has been filed in the State of California by Alan Keyes, a former presidential candidate and rival of Obama’s, who along with a series of other organizations including the United Justice Foundation, are petitioning the California secretary of state asking that the state's 55 Electoral College votes slated to be cast in the 2008 presidential election on behalf of Barack Obama be withheld until he verifies his eligibility to hold the office of president.

 

According to conservative website World News Daily, the California case states, "There is a reasonable and common expectation by the voters that to qualify for the ballot, the individuals running for office must meet minimum qualifications as outlined in the federal and state Constitutions and statutes, and that compliance with those minimum qualifications has been confirmed by the officials overseeing the election process."

 

"Since [the secretary of state] has, as its core, the mission of certifying and establishing the validity of the election process, this writ seeks a Court Order barring SOS from certifying the California Electors until documentary proof that Senator Obama is a 'natural born' citizen of the United States of America is received by her," the document said.

 

"This proof could include items such as his original birth certificate, showing the name of the hospital and the name and the signature of the doctor, all of his passports with immigration stamps, and verification from the governments where the candidate has resided, verifying that he did not, and does not, hold citizenship of these countries, and any other documents that certify an individual’s citizenship and/or qualification for office.

 

Taking on the issue of the "certificate of live birth" posted by the Obama campaign, the California case alleges that it cannot be viewed as authoritative, given that:

 

"Hawaii Revised Statute 338-178 allows registration of birth in Hawaii for a child that was born outside of Hawaii to parents who, for a year preceding the child’s birth, claimed Hawaii as their place of residence," the document said. "The only way to know where Senator Obama was actually born is to view Senator Obama's original birth certificate from 1961 that shows the name of the hospital and the name and signature of the doctor that delivered him."

 

The case also raises questions about the circumstances of Obama's time during his youth in Indonesia, where he was listed as having Indonesian citizenship. Indonesia does not allow dual citizenship, raising the possibility of Obama's mother having given up his U.S. citizenship, according to World News Daily.

 

The Obama campaign has called the barrage of lawsuits ‘garbage.’

 

Meanwhile FactCheck.org offers the following explanation regarding the circumstances surrounding Barack Obama’s birth and his subsequent eligibility to become president:

 

“When Barack Obama Jr. was born on Aug. 4,1961, in Honolulu, Kenya was a British colony, still part of the United Kingdom’s dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.‘s children.

 

Since Sen. Obama has neither renounced his U.S. citizenship nor sworn an oath of allegiance to Kenya, his Kenyan citizenship automatically expired on Aug. 4,1982.”

Kenyan Ambassador to the United States, His Excellency Peter Ogengo, Admits Obama Born in Kenya

 

Update 24 NOVEMBER 28: Kenyan Ambassador Peter Nicholas Rateng’ Oginga Ogego appears to be finding himself in hot water both in Washington and in Kenya. However, that hot water is not due to his on-air comments to Detroit's WRIF FM 101 "Mike in the Morning" program regarding Barack Obama's Kenyan birthplace, the hot water is due to Ambassador Ogego's stinging criticism of Senator Barack Obama before Mr. Peter Oginga Ogego officially became Kenya's Ambassador to the United States on 5 September 2006 and two years prior to Barack Obama's apparent victory in the U.S. Presidential election.

 

 

Mr. Ogego's criticism of Senator Obama was as follows according to the Kenyan Daily Nation newspaper:

“You deliberately, without real cause or reason, other than what appears to be to seek cheap publicity and inconsequential populism, chose to publicly attack the democratically elected Government of Kenya, in total disregard for the requisite protocol and acceptable methods to address the issues you raised, what with programmed appointments to meet Cabinet ministers and even the Head of State, since your visit was official.”

 

 

 

 

In 2006, speaking as a Kenyan citizen Mr. Ogego was rightfully incensed at Barack Obama's insertion of himself into Kenyan politics as well as Barack Obama's uncalled for attack on the democratically elected Government of Kenya during an official visit to the country. This blatant interference in Kenyan politics occured when Barack Obama was in Kenya to campaign and provide financial support to his cousin, Raila Odinga, prior to the violence which was deliberately set in motion by the Odinga camp when he lost the election. 22 NOVEMBER 2008: During a recent program aired on Detroit's WRIF 101 FM "Mike in the Morning" radio program a decision was made to make a phone call to the Kenyan Embassy in Washington D.C. for the obvious purpose of having a little fun and in order to congratulate Kenyan's on the occassion of Barack Obama's election.

 

 

 

 

During the course of the call Mike and his co-host Trudy were connected to the Ambassador's office and after a short conversation with a secretary the Ambassador, His Excellency Peter OGEGO, pictured below, picked up the call.

 

At approximately 12:30 into the MP3 recording another of Mike's co-hosts asks Ambassador, "President-elect Obama's birthplace over in Kenya, is that going to be a national spot to go visit, where he was born?"

 

 

 

Ambassador Ogego responds, "It's, um, already an attraction. His, his, uh, pateral grandmother is still alive..."

 

 

The questioner then interjects, "But his birthplace, they'll put up a marker there?"

 

 

Ambassador Ogego responds, "It depends on the government, it's already well known."

 

Kenyan Ambassador Peter Ogego just annouced to the whole world on live radio that our assumed President-elect Barack Hussein Obama was born in Kenya, his birthplace is already an attraction, and placing a marker is up to the Kenyan government, but the location is already well known, intimating the the location does not need anything further to distinguish it.

This admission is a confirmation of the multiple statements made by Obama's paternal grandmother, referenced by Ambassador Ogego, about Obama's Kenyan birthplace.

The question of whether Barack Obama was actually born in Kenya thus disqualifying him to run as a presidential candidate will not go away. It is like the little mushrooms that appear every morning under the tree, they keep coming back. What should the President Elect do?

 

It is not fair to label those who want answers as racists, disillusioned right wingers, conspiracy nuts or any other convenient appellation thereby asking them to simply shut up. Lawsuits filed to require that an official vault document be produced have come from African Americans, democrats and a host of constitutionally concerned citizens.

 

In fact one You Tube offering about the matter garnered 750,000 views alone and the total viewing of videos and articles on the subject is somewhere near three million to date.

 

The problems with the birth certificate offered on the extreme left website the Daily Kos and a few other internet sites are too many to ignore. The short list is first that the document is not signed. Secondly it has no seal. Third is that the security border doesn't match similar documents from the same time period. Other objections are that the race of Obama's father is listed as African. In the early sixties the State of Hawaii listed African Americans as Negroes.

 

What is missing from the document is the doctor's signature and physical characteristics at birth that every original birth certificate reveals.

 

Some interested party's have submitted the internet document to the scrutiny of Adobe and graphic experts who all agree the document is highly questionable or a complete fraud. Is it? Who knows at this point? What is far more intriguing is the resistance being thrown at uncovering the true vault document. This is what is spawning suspicion and doubt.

 

Attorney Philip Berg has filed a writ of certiorari that should force the President Elect, the DNC and Co-Defendants to produce the document in accordance with law. Ambassador Alan Keyes has pending suits and a total of seventeen others are submitting their quests to various levels of state courts.

 

Here are the important reasons President Elect Obama should cooperate and put the whole matter to bed as quickly as possible.

 

 

1. Because he can. With a simple request to the Hawaii Bureau of Vital Statistics he can quash all doubt and get on with his administration.

 

 

2. He will remove the suspicions of millions of Americans, republicans, democrats and independents alike.

 

 

3. If ignored it could cause a constitutional crises unlike anything ever seen in this country. It would make questions of chads and incomplete voting cards look like a kindergarten problem by contrast.

 

 

4. It will indicate that Obama means business when he takes the oath of office and declares that he will uphold and defend the Constitution of the United States.

 

 

5. It will give confidence to many of his opponents who may not agree with all his policies, but want to know that he is a completely honest man with the country's best interest in mind.

 

 

6. It would put to rest the assertion that he is an elitist. All Americans must submit proper documentation of birth to get Social Security cards, driver's license, security clearance and passports. He should be willing to carry out the first and the least of all his campaign promises contained in the slogan 'Yes, we can.' In America we can and according to law 'we must.'

 

 

7. We will all sleep better at night!

 

 

It is a surprisingly simple matter to make it all go away but it is presently entrenched in court battles and suspicion. In a full page ad in The Washington Times Nov. 17, 2008 three questions are asked. Was Barack Obama born in Kenya? Is he really a citizen of Indonesia? Does the constitution still matter?

 

Good questions, we're listening.

 

As a footnote even Jesus Christ was questioned about who he was and where he came from. "We know that God spake unto Moses: as for this fellow, we know not from whence he is." (Jn 9:29) His own sisters and brothers warned him about doing things openly. "For there is no man that doeth any thing in secret, and he himself seeketh to be known openly. If thou do these things, show thyself to the world. (Jn 7:4)

WASHINGTON – Supreme Court Justice Anthony Kennedy has rejected two more efforts to get the court to consider whether President-elect Barack Obama is eligible to take office.

 

Kennedy on Wednesday denied without comment an appeal by Philip J. Berg, a Pennsylvania attorney, that claims Obama is either a citizen of Kenya or Indonesia and is ineligible to be president because he is not a "natural-born citizen" of the U.S. as required by the Constitution. Another appeal from California, based on Berg's claims, also was denied.

 

Individual justices and the entire court have turned down emergency appeals over Obama's eligibility at least seven times in the past six weeks.

 

Obama was born in Hawaii in 1961 to an American mother and a Kenyan father.

 

Reacting to Internet-fueled conspiracy theories that Obama's birth certificate is a fake, Hawaiian officials have said they examined the document and have no doubt it is authentic.

If you read (or listen) to the Wong Kim Ark case cited above, this is the case in a nutshell. Wong Kim Ark, was a young Chinese man born in San Francisco, California. His parents were subjects of the Emperor of China even though they were permanently domiciled in California. Ark left the U.S. for a short period of time for a visit to China. Upon his return, he was denied entry back into the U.S. because he was not a natural born citizen at birth. This was challenged in the U.S. Supreme Court.

So I guess Hawaiian Democrats had the foresight all the way back in 1961 to place a fake birth annoucement in the Honolulu Advertiser for a president elect 47 years later who really wasn't born in the US? Or did they just travel back in time?

I like the idea that he had to renounce his citizenship to go to Muslim school overseas with stepdad.

 

But AFAIK he was born here and that's his sole qualification to be president.

Answer the question. WHY IS IT SEALED. Is Bush's sealed? McCain's sealed? Palin's sealed?

anybody know of anybody who has their birth certificate SEALED?

 

Just askin. With it being SEALED, this sounds like the usual practice?

 

And the DEM governor refused to allow it to be unsealed? Or was that a DEM judge in Hawaii....
