for those who love to waste the courts time

How is this wasting the courts time? If you bought an item advertised to work a certain way(in this case lasts 15hrs) and it doesn't work as advertised its false advertisement.

 

Now if it was someone who doesn't realize the coffee is served hot, that would be something different.

But the stupid bitch who didn't realize hot coffee should not be poured into one's crotch did receive an award.

And that was a horrible waste of the court system, this seems more legit. IF the lawyer can prove that the 15hr claim is false or misleading and IF Estee Lauder can't back up their claim, then Estee Lauder is on the hook for false\misleading advertising(which usually ends up in a retraction\apology by the company) but would need to be decided in court, if it could not had been resolved out of court. Since she "does not seek any damage herself" Estee Lauder is not facing any financial burdens(besides court costs),

Nobody's gaining anything? Please I saw her douchebag lawyer getting his stupid mug on the nightly news, that's gotta be worth something right? And pardon me if my trust of the legal profession will be considered lacking but I'd say this publicity stunt mate is inches away from morphing into a class action suit. Actually I hope Estee Lauder backs it up and sue's both of these assholes.

The inquiry was closed without any action against Mr. Schlachet. Mr. Zipkin was convicted of embezzling a client's money last year."

If that's a lower level civil court then it's not a waste of time.

 

 

 

But Vitolo said those statements are misleading and wants the New York-based Estee Lauder company to immediately stop its “deceiving” sales messages.

 

“Basically what we’re seeking is an injunction,” Cleveland Heights attorney Mark Schlachet said.

 

It doesn't sound like she wants retire to her own island settlement money, she wants estee lauder to stop falsely advertising a product.

 

The counter argument is that in a free market system, once word gets out that it fails then it wouldn't matter how or how much Estee Lauder advertised. But people will often buy a product that does not get the results that it advertises. Drinking Dos Equis in a responsible manner will not make you the most interesting man in the world.

 

All she probably needed to do was to send an email to the FTC and they would have sicced their watchdogs on Estee Lauder. In the hunting/outdoor market that happened to some of the people that made and advertised activated carbon suits to prevent deer from smelling deer hunters. some of these products worked really well for 90% of the hunters, but that wasn't good enough.

 

A true waste of the courts time is former Senator and one time Democrat Presidential Hopefull John Edwards, who on the stand in court "channelled" the spirit of a dead baby to win a malpractice suit. It's those types that make the process repugnant to Joe Citizen.
