The Christian baker has freedom of religion - it is a given if they had to prove that their religious beliefs would be contradicted in a major way by being forced to bake that cake. Is the restaurant owned by the government? If not, the constitution doesn't say anything for or against a private business choosing to decline service based on religious leaning.
