If you threw the 9th and 10th amendments into the discussion, up until the 1930s and the FDR administration it was commonly understood that the Federal Government could not regulate speech. Or establish a religion. Or prohibit the free exercise of your religion (unless you were Mormon)

 

 

But the States and their own localities could and did have their own speech codes, and some states for a while, after ratification had official state sanctioned sects of Chrisitanity.

 

Under an original, true Federalist understanding of the Constitution you could realize that Oklahoma could have their own regulations on what constitutes appropriate speech. This is not to approve or disapprove of Oklahoma U's behavior at the top, especially if you balance it against the actions of their scholar athletes in the Oklahoma Sooner football program.....
